Acceptable Use Policy

This Acceptable Use Policy ("AUP") describes activities that are prohibited when using Octelligence ("we", "us", or "our"). The AUP supplements and is incorporated into the Octelligence Terms of Service. Capitalized terms used here have the meanings given in the Terms of Service.

1. Scope

This AUP applies to all use of the Service by Customer, Authorized Users, and anyone accessing the Service under or through Customer's account. Customer is responsible for ensuring that all use under its account complies with this AUP.

2. Prohibited Activities

You agree not to, and not to permit any Authorized User or third party to:

  • Use the Service in violation of applicable law, regulation, or third-party rights.
  • Use the Service to engage in fraud, money laundering, securities violations, market manipulation, tax evasion, or other unlawful conduct.
  • Misrepresent your identity, authority, or affiliation with any person or entity.
  • Send unsolicited commercial communications ("spam"), phishing messages, or other deceptive communications through the Service.
  • Use the Service to harass, threaten, defame, or harm any individual or organization.
  • Resell, rent, lease, sublicense, distribute, or otherwise make the Service available to any third party except as expressly permitted in the Terms of Service.
  • Use the Service to build, train, evaluate, or support any product or service competitive with the Service, or for competitive benchmarking without our prior written consent.
  • Use the Service in a manner intended to avoid usage limits, fees, or controls.

3. Prohibited Content

You may not upload, transmit, store, or share content that:

  • Infringes any patent, copyright, trademark, trade secret, right of publicity, or other intellectual property right.
  • Is unlawful, defamatory, libelous, obscene, sexually explicit, exploitative of minors, or otherwise harmful or objectionable.
  • Contains malware, viruses, worms, ransomware, time bombs, or other malicious code.
  • Is designed to deceive, defraud, or mislead other persons, including forged or backdated corporate documents.
  • You do not have the necessary rights, consents, or authorizations to upload or process through the Service.

4. System Integrity & Security

You may not:

  • Attempt to gain unauthorized access to the Service, other accounts, computer systems, or networks connected to the Service.
  • Probe, scan, or test the vulnerability of the Service or any system or network, except in accordance with our Responsible Disclosure Policy.
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive source code, ideas, or know-how from the Service, except to the extent permitted by applicable law.
  • Copy, modify, translate, adapt, or create derivative works of the Service or Documentation.
  • Interfere with or disrupt the integrity, performance, or availability of the Service, including by conducting denial-of-service attacks, generating excessive load, or interfering with other users.
  • Conduct automated scraping, crawling, or data harvesting against the Service without our written consent.
  • Remove, alter, or obscure proprietary notices, watermarks, or branding in the Service or Documentation.
  • Bypass or attempt to bypass authentication, access controls, rate limits, or audit mechanisms.

5. Restricted Data Categories

Without our prior written agreement, you may not upload to or process through the Service any of the following:

  • Protected Health Information ("PHI") regulated under the U.S. Health Insurance Portability and Accountability Act (HIPAA) or comparable laws.
  • Cardholder data as defined under the Payment Card Industry Data Security Standard (PCI-DSS) outside of the tokenized payment flows handled by our payment processor.
  • U.S. government classified information or information regulated under the International Traffic in Arms Regulations (ITAR).
  • Personal information of children under the age of sixteen (16).
  • Biometric identifiers, except where expressly permitted by feature.
Octelligence is not designed for, and the Service is not certified as a system of record for, the categories above. Customers requiring these capabilities should contact us before storing such data in the Service.

6. Enforcement

Violations of this AUP may result in suspension or termination of access to the Service, removal of offending content, reporting to law-enforcement or regulatory authorities, and any other remedies available under the Terms of Service or applicable law.

Where reasonably practicable and not prohibited by law or by the nature of the violation, we will provide notice and an opportunity to cure before suspending or terminating access. Material violations, including those involving illegal content, security threats, or risk of harm to other users, may result in immediate suspension without prior notice.

7. Reporting Violations

8. Updates to This Policy

We may update this AUP from time to time to reflect changes to the Service, evolving threats, or legal and regulatory developments. Material changes will be announced through the Service or our website. Continued use of the Service after the effective date of an update constitutes acceptance of the updated AUP.
